Deposits are non-refundable under any circumstance.
Deposit Policy
Purpose This Deposit Policy sets forth the terms and conditions governing deposits paid to Swan Meadow (the "Company") in connection with the reservation or purchase of goods or services.
Deposit Requirement A deposit is required to secure a reservation or initiate performance of services as specified in the applicable invoice, proposal, order confirmation, or other written agreement between the Company and the Client (the "Agreement").
Non‑Refundable Deposit All deposits paid to the Company are non‑refundable under any circumstance. Once received by the Company, a deposit will not be returned to the Client for any reason, including but not limited to cancellation by the Client, termination of the Agreement, change of mind, failure to attend scheduled appointments, or inability of the Client to complete the transaction.
Application of Deposit The Company will apply the deposit toward the final price or fee specified in the Agreement, unless otherwise stated in writing. If the Agreement is terminated or services are not rendered for any reason, the deposit will be retained by the Company in full and will not be credited, offset, or otherwise returned.
No Waiver Acceptance by the Company of any payment, including a deposit, does not waive the Company’s right to enforce this Deposit Policy or any other provision of the Agreement.
Legal Remedies Retention of a non‑refundable deposit is in addition to, and not in lieu of, any other remedies available to the Company under law or equity for breach of the Agreement.
Governing Law This Deposit Policy and any dispute arising out of or relating to it shall be governed by the laws of the state specified in the Agreement, without regard to conflict of law principles.
Severability If any provision of this Deposit Policy is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
